Do I need a Will or a Trust? is a book written by Taylor Phillip Willingham, J.D. M.S. The author is a lawyer by profession and he wrote the book based on his personal experience. He gave the definitions between the two terms and went on to give the reasons why one should consider a trust and not a will. Because a will is mandatory and everyone should have a will. The reasons for choosing a trust includes, avoiding probate, avoiding creditors, protecting oneself and the beneficiaries from themselves etc. From his experience, the main reason why people do not create a trust is because of the costs associated with creating one.

The author explained clearly the different types of trusts available. They all depend on a person’s needs. He also advised that anyone who needs to create a trust should speak to professionals to avoid making mistakes. The book gives a lot of reasons why one should or should not create a trust. A trust is also good for privacy purposes because it will carry its own name and not the name of the trustee.

I liked the quotes from Jim Gaffigan and the memes used by the author. They carry a lot of humor. The author unveiled everything about trusts and wills that anyone can be able to understand. I always thought trusts are complicated but after reading this book I fully understand them and the different types available. I also liked that a trust can save a lot of purposes and can help avoid conflicts and taxes. The author described how a will should look like to be considered as a valid last will of testament, assisting any man to avoid making mistakes in drafting one. I did not have a will but after reading the book I’m definitely writing one.

I also liked that the book gives some very practical examples making it very easy to relate. Last but not least it motivates one to do the right thing. The author is well versed in Texas law and not in other states or countries and that limited the book to Texas state and one will have to research more on what applies to the area they are. The end notes were also focused on Texas issues and laws and made it difficult to follow. I did not read most of the end notes because they disturbed the flow of the book.

The book is well written and very educational. I would definitely preach about it to my relatives and friends. It’s a good book. I rate the book 4 out of 4 stars .
