Review of the Book. India in Chaos.By KC.Agrawal

This is an updated and enlarged version of a previously published book in the name of" India in Shambles: Only the Judiciary can Save Us”. The book which is of 529 pages named India in Chaos, by KOMAL Chandra Agrawal is a humble submission to the Honorable Judiciary of the Republic of India, says the author. Forward of the book has been written by Justice M.N. Venkatachalam, former Chief Justice of India, and prologue has been written by Justice K.G. Balakrishnan, another former Chief Justice of India. Preface has been provided by Ram Jethmalani, Member of Parliament (Rajya Sabha) and Senior Advocate, Supreme Court of India.

The book is expected to help the politicians of all classes. Author has taken enormous pains to write this book and great amount of research has gone into the making of the book. Even though its contents are dotted with charts and tables and sections of various laws, it makes interesting reading. The development, which is taking place in the country varies from state to state, like for example, the state of Kerala has developed into in a small way into a welfare state not exactly the kind of welfare state which is found in other developed nations. Likewise States in South India, almost all states, have developed, when compared to north and north-eastern states.

KC.Agrawal’s book is a testament of thorough inquest and an endearing inquiry into the present day politic and socio-economic dynamics of this country,India. The author has delved into the role and importance of the judiciary to preserve and also to high light the spirit of constitution.The book is like a case history of a hospitalized patient which also provides answers to most of the socio-economic and socio-legal problems ailing the country at present.

The fundamental objectives as per the Constitution is economic freedom, dignity, equality, opportunity and fraternity. All these objectives are not fulfilled in the present situation by the guardians, legislator and the executive, hence the responsibility now shifts to the judiciary to discharge these duties to provide responsible and accountable governance in all the states as well as in the center, this is the basic theme of the book. As they remain underachieved, in the last 70 years of rule by various Governments,author says it is tantamount to gross human rights violation.

The author KC.Agrawal has written this book in three parts.Part one tells about the last 70 years of the lives of Indian people, how and why the fundamental rights were unfulfilled and, part two tells about the Constitution of India, what are its objectives,what are its successes and what are its failures. Part three provides guidelines and road maps for the empowerment of the population and also to transform and develop the nation.

In the last part, paper cuttings have been included. Most of the cuttings are from various newspapers, but the news given are unique, which may not have been read or known by most people. Like for example, one clipping from Times of India 2.3. 2013 gives the news that” most government schools don’t have water, food, and teachers”. And the clipping from times of India 16.01.2000 gives the news thus.”38% class five students in rural areas cannot divide”. Another from Times of India again dated 16.01.2010 states that” only 44% kids in class one knows English alphabet”. Very unique news clippings collected by the author.

It can be read and enjoyed by people who are highly educated or people who are in the judiciary or law and it is also suitable for those connected with present day politics like people in the administration. A must read for high profile political leaders, legislators, students of political science, and also for researchers, and journalists. Also a recommended reading to Govt officials and to anyone who is interested in the welfare of the country.The book which is 529 pages strong can be assimilated and understood only by highly educated people, since the contents are dotted with charts and other statistical data which an ordinary reader may not comprehend and topic dealt with is also not for the common man.

Part-1.The first part deals in the country’s economic regression, human Rights violations & disintegrating fraternity, economic backwardness, corruption, and scandals. Also, about the power shortages, lack of job opportunities, failed agricultural production, inflation, high prices, and host of other factors.

In a way all this means a huge human rights violation, directly affecting the welfare of the people. People have a right to live in a favorable socio-economic situation. The author mentions that these human rights violations fall under the purview of the judiciary and court can and should come to the rescue of people’s rights.A number of brief references to some vital human resource requirements as promulgated by the United Nations (UN) to its member countries is provided in chapter 4. It’s about judiciary,the third most powerful guardian of our nation. Some of the narrations are concentrated on human rights violation aspects,which are explained by the writer.Details about the failure of the two guardians,the legislator and executive, which have necessitated responsibility to fall on the judiciary to fulfill the dreams of the people.

The book in this part also tells about what is ailing the country and what steps could be initiated to make the country surge forward. This book stresses the importance of judiciary for the protection of the fundamental rights of the people rather than by the Parliament. Basic function of the judiciary is to protect the rights of the people and all its actions must be directed to further this responsibility, which otherwise is not protected by the executive or by Legislative.The book India in chaos depicts a gloomy picture of the present situation of the country.

It explains how the various infrastructure institutions of the country are lagging behind their schedule, shows the conditions in all major industries like the railways, the airlines, power industries, environmental quality, water shortage, are falling short of our expectations. A number of scams and swindling of hundreds and thousands of millions of rupees are reported every day, involving national wealth. The purpose of this book is to pinpoint and identify the causes of the crumbling down of the government functions, misuse of resources and also to suggest remedies to stop further deterioration of our natural resources and how we can have a responsible government.

The author, KC Agrawal has suggested various steps to turn around the country into a financially stable economy and also to deliver responsible governance to the people of the country. Moreover, going through this book, the general public will get an idea and awareness of the reasons for the failures of various governments and how we can tackle this properly.
In this age of political killings, and murders of writers in India, the author has achieved or tried to achieve through this book the need to have a responsible and accountable Government. Part one deals mainly with the judiciary and judiciary‘s capacity to guard the nation and its people. Along with the name of the book, in the initial pages of the book it has been explained that "only the judiciary can save the country". As the name suggests the author has successfully stressed and justified the importance and reasons for judicial activism in the country.

PART 2. In this Part of the book the author has tried to diagnose the causes of failures and also how we can still accomplish a ‘Responsible and Accountable System of Governance at the Union and at the States’ with the help of learned Judiciary.

Part two deals with the causes of our failures. This part deals with the past 70 years of mistakes and the author has tried to find the reasons for the failures. The book teaches a general reader of various not so known UN resolutions intended for the protection of human rights and also for the development of nations. The author is of the opinion that human rights protection is one of the fundamental programs for the overall development of any country.
The author cites a number of UN treaty documents and reports to highlight his point. He also mentions about the International bill of human rights. There is a human rights body in UN which is known as Human Rights Council. It was created in 2005.He mentions the human rights crisis in Egypt Libya Syria Iraq and other west Asia Iran and North African countries.

The book while reading provides a lot of new knowledge hitherto unheard of to the reader. For example, UN’s role in the keeping of internal peace in every individual nation. Here also the author depicts the highly dilapidated condition of the country and its people. One Chapter has been marked for the efforts of United Nations in the protection of human rights. Various treaties and international laws are mentioned here. International bill of human rights, human rights activities of Europe, Human Rights Council, UN treaty bodies, Constitution of US, Constitution of South Africa, Constitution of Germany, Constitution of UK, Constitution of Japan are discussed in Part two. Corruption has become a way of life and has assumed gigantic proportions and it has become quite unwieldy. The writer has tried to mention and substantiate how the human rights activity and the economic progression of a country is related.

Here,in the second part the author extensively narrates the cause of India’s failures.
The author mentions of the need to stress to implement the laws stringently. The law has to be implemented in letter and spirit. Here the author has passionately written a submission to the learned judiciary to save the country. And he also mentions that the Constitution of the country is above the Parliament and judiciary is its custodian. Judiciary is a third eye. He advises to have a real-time service in the system to oversee the working of the legislators and executives and to initiate corrective issues whenever necessary. Here he discusses various aspects of election process and reforms of the Election Commission. The effects of quotas and reservations are discussed.

PART 3. In the beginning of part three, the author narrates a number of concrete steps for the revival of the economy as well as for the development of the country. Guarantee of jobs to 100% workable hands, making optimum use of talent and expertise, judicial use of natural resources, optimization of agriculture and secondary sectors, exercising population control, removal of illiteracy etc are a few suggestions. The country has unexplored natural resources which can be put to use and the country also has enormous manpower, young and qualified. Our villages will have to be developed.

He mentioned number of ways and methods for the development of our villages as well as agriculture. He puts forward an idea about City Centers. City centers are in the style of Software Export Zones, places to educate and empower the rural uneducated masses and make them good citizens, who work for the nation and at the same time ensuring a dignified living for the rural masses. The main idea of city center is the development of the villages into a full-fledged village with sustainable income. There are around 0.5 million villages in the country. Most of these are under developed. As per the suggestion, the idea of clubbing of villages is a unique one. He proposes to have 1000 such center around the country.

He has suggestions for all the activities in the city center, various suggestions are given for agriculture, railways, gas industries, roads etc within the city centers. It will also bolster community feeling and togetherness in the centers. He has recommended a bridge course of training for entrepreneurs before they start an industry. The farm lands in centers will be well connected through road and rail networks to cover the whole nation. He talks of other plans about rehabilitation of the disabled and the old.

He gives data on education and educational institutions. And also, suggestions for the improvement of the educational system. A chapter has been provided and discussed about various types of industries including exports. He has suggested methods and ways to do all the activities within the city centers including how to develop industry, agriculture, marketing, etc, functioning of hospitals, schools and the like. He has touched upon every aspect of human life. The development of each city center will be the primary aim of the government for the total development of the country. The help and expertise of the town planners could be used for the development of the city center. The same can be established and maintained under Public Private partnership. Another chapter deals in the control of population. Its effect on global warming, health and the overall well-being of the nation.

We have a youthful population. He also discusses whether the youth is an asset or a liability. All these are supported with figures and charts. The next is education. Discusses about the qualification of teachers, scams in the recruitment of teachers, various scams in the examinations, conditions of the schools, number of students in schools, number of schools etc.

Regarding water management, causes of water, scarcity, floods, droughts, famines, and water storage etc are narrated. Causes of disaster preparedness, actions to prevent disasters, precautions in cases of disasters are discussed under the topic of disastrous management.The importance of power has not been neglected. A chapter has been provided for power, hydroelectric power, power generation non-conventional energy, solar energy, wind energy, nuclear energy, biomass energy etc. Improving environment is another, which the author has narrated in this part of the book. Pollution, global warming, handling of various types of waste like industrial, household, are discussed. Urbanization and the consequent destroying of forest area, IT and research are another important area where the country is lagging behind. At the end of the book, technical words and its meaning are given.


Overall, I give a rating of 4 out of 4, since I feel that the book is very informative and a lot of research has been done while writing the book. More over it is a useful book for students in the field of political research, legislators both in parliament and various assemblies. It is also suitable and a must read for politicians and also for people who aspire for the good of the country. The rating has also been given because the book points boldly at the reasons of the failure of the politicians, parties, ministers, Governments during the 70-year period for the backwardness of the country. And suggests remedies. The book has been strongly written,the arguments discussed are very relevant about this country in today’s world. The author has worked against odds, and the book is primarily intended to uplift the masses by educating them, and to improve the quality of their life, with a noble, highly appreciable worthwhile intention.

The book India in chaos has been well edited and proof read. There are no typos.
What I like most about the book is- the presentation of some very new and fresh ideals. Some of the concepts explained have been found to be unique. Not found anywhere.Like for example, -discipline of the people, City Center etc. The reason for judicial activism accused on the judiciary by the political parties has been clearly explained with details.

What I dislike about the book is the size of the book. The book is 529 pages long and Since the book is a non-fiction, it may not be suitable for people who are looking for novels.

Summary.

India in chaos By KC. Agrawal is a book of 529 pages, is a submission to the Chief justice of India. The book has been appreciated by two of the former Chief Justices of India and also by various eminent personalities. The author submits the book to the Honorable Judiciary of the country and pray for the establishment of a responsible and accountable Government at all levels. The overall theme of the book is that the country must be liberated from backwardness, illiteracy and poverty. For this the intervention at various levels of the Judiciary is necessary.This book contains sufficient material for any person who is interested in approaching the Court, for an accountable Government. A time is not far off when we will have to abolish the acts of schedule casts and schedule tribes, backward classes etc, once these people are uplifted. The country cannot progress when the guardians are reluctant onlookers when the country is rotting. The 70 years rule of democracy has not been sufficient for the improvement of the the masses from poverty and backwardness.They are still illiterate, unemployed and struggle to meet both ends. India is still one of the poorest nations of the world. Here the author is of the opinion that the Judiciary, the third most powerful guardian has an important role to play.

The book is all about the causes of the failure of our various departments, industries and the Government machinery all thru these years and the remedies to cure this. This book is a pointer to the rot that is progressing which will consume the nation, and unless stopped will pave the way for the disintegration of the nation. This Book is divided into three parts, part-1 states the failure of the nation towards its people, part-2 the causes of the failure and part-3 the ways to improve the conditions of the people, remedies to cure the malignancy. Various methods are suggested, the most important one, creation of City Centers.
